Right of way acquisition is what is delaying construction of an access road at the former Hobet Mining site in Boone County.
The $39 million access road and bridge project were supposed to start almost immediately after Governor Justice held a press conference at the site last year.
The project cannot start until all rights of way have been attained.
Department of Highways officials say they expect to be able to advertise for construction bids in the spring with actual construction beginning in the summer.
The access road will cover close to 144 acres.
